Biogenesis Investor Says Clinic?s Client List Included NBA, NCAA Players

The office where Biogenesis of America was located is seen on the first floor in Coral Gables, Florida. (Photo by Joe Raedle/Getty Images)

NEW YORK (CBSNewYork/AP) ? A former associate of Biogenesis head Tony Bosch said he turned down a $125,000 offer from Major League Baseball for documents said to implicate players in the use of performance-enhancing drugs.

In an interview broadcast Thursday on ESPN?s ?Outside the Lines,? Porter Fischer also said an additional dozen athletes from different sports ? whose names have not been made public ? were involved in the now-closed Florida anti-aging clinic.

?This isn?t a 2013 thing or a 2012 thing,? Fisher said. ?Some of these people have been on the books since 2009.?

Fischer, 49, admitted to investing in Biogenesis and giving documents to the Miami News Times, which published a story in January detailing the alleged purchase of performance-enhancing drugs by Yankees slugger Alex Rodriguez, 2012 All-Star game MVP Melky Cabrera, 2005 AL Cy Young Award winner Bartolo Colon and 2011 AL championship series MVP Nelson Cruz.

A-ROD: I?M READY TO PLAY; YANKEES: NO YOU?RE NOT

Others were later implicated in media reports, including Milwaukee outfielder Ryan Braun, who agreed this week to a 65-game suspension. Baseball?s probe of other players is ongoing.

In a story on ESPN.com, Fischer said some of the unnamed athletes were from the NBA, NCAA, boxing, tennis and MMA.

?In just the four years that I know, it?s got to be well over a hundred, easy,? Fischer said. ?It?s almost scary to think about how many people have gone through (Biogenesis) and how long he?s gotten away with this.?

Fischer said he received $5,500 in cash from MLB?s investigation. The network reported he rejected the larger sum because it wasn?t enough to restart his life.

?Once I turned them down for the $125,000, two days later they wrote me a letter instructing me not to destroy any documents and to keep them around,? he said. ?Then two days after that on the 24th of March, I was transporting evidence back to the state investigator for him to follow up on some criminal activity, and my car was broken into and four boxes of evidence were taken.

?I?m still amenable to working with them,? he added. ?Because of this, now my employment opportunities are limited. I feel that I have something good to say. Just like anything else, I feel like my cooperation and compensation should go hand in hand or at least be evaluated.?

Fisher said when he first started working with Bosch, he thought Bosch was a doctor. Bosch?s failure to pay him money he was owed caused him to give documents to the New Times. At the time, he decided against contacting police or prosecutors.

?I didn?t feel comfortable going to local law enforcement,? he said.

Fischer claimed he received death threats from someone wanting to stop the article from being published.

?I don?t have any friends anymore,? he said. ?I don?t go to the same locations I used to go to. My blinds are closed all the time. I have a concealed weapons permit, but now I continually carry a weapon.?

Irish watchdog won't probe U.S. firms over Prism

    By Georgina Prodhan

VIENNA (Reuters) - A watchdog in Ireland, home to the European headquarters of Apple and Facebook, says it will not investigate them for transferring personal data to a U.S. spy agency because they have signed up to EU privacy principles.

The Irish Office of the Data Protection Commissioner (ODPC), had been challenged by an Austrian student activist group to investigate allegations that the U.S. National Security Agency harvests emails and other private data from the companies in a mass electronic surveillance program known as Prism.

But in an email published by the student group, europe-v-facebook, the ODPC said the companies were covered by 'Safe Harbour', a system that allows U.S. firms to certify themselves as compliant with EU data protection law by signing up to a set of principles supposed to safeguard how personal data are used.

The European Union adopted Safe Harbour in 2000, seven years before the NSA began the Prism program that was revealed by fugitive intelligence contractor Edward Snowden last month.

"We do not consider that there are grounds for an investigation under the Irish Data Protection Acts given that 'Safe Harbour' requirements have been met," the ODPC wrote to europe-v-facebook.

An ODPC spokeswoman told Reuters: "If something is agreed by the European Commission for the purpose of providing safeguards, that ticks a box under our jurisdiction."

Max Schrems, the founder of europe-v-facebook, said: "We have the impression that the ODPC is trying to simply ignore the complaints and the whole Prism scandal."

The 25-year-old law student is also awaiting responses to complaints he has filed against Yahoo in Germany and Microsoft and Skype in Luxembourg.

    LEADERS PETITIONED

Snowden's leaks about NSA eavesdropping methods have caused widespread outrage among both friends and foes of the United States. Freedom-of-expression group Index on Censorship launched a petition together with five other campaign groups on Thursday calling on European heads of government to discuss the issue at their next summit in October.

Ireland, which has courted U.S. business for decades and offers attractive tax rates, is home to the European headquarters of some of the biggest U.S. technology companies including Microsoft and Google, which are also alleged to have cooperated with the Prism program.

The companies, which are restricted by law as to what they can disclose about their involvement, say they have not given direct access to their servers to any government agency, and have only provided user information in accordance with the law.

The Snowden affair has raised questions about the efficacy of Safe Harbour. The data protection commissioner for the German state of Bremen called on Wednesday for the European Commission to suspend it indefinitely in light of the "excessive surveillance by foreign secret services".

Viviane Reding, the European Commissioner for Justice, Fundamental Rights and Citizenship said this month: "The Safe Harbour agreement may not be so safe after all." A spokeswoman for her office said the Commission was working on an assessment of the agreement, which it would present by the end of the year.

Should I try to get a job flipping burgers or volunteering for the experience, or would this field unrelated-work work against me? Is it worse to keep looking for an entry level position or internship if it means risking going another year without either?

Sympathy for China airport blast protester

BEIJING - Chinese citizens expressed support on Sunday for a disabled man who set off an explosion at Beijing's international airport, injuring himself in an apparent protest against police brutality.

Chinese security personnel move in to investigate the scene where a man in a wheelchair ignited a home-made explosive device at Beijing's international airport terminal 3 on Saturday, July 20, 2013, injuring himself but no others. (AFP photo)

Messages of support posted online came after reports said 34-year old Ji Zhongxing was driven to the act by a years-long battle for justice after being severely beaten by police.

Wheelchair-bound Ji warned passengers in the airport before detonating the small device late on Saturday in an apparent attempt to draw attention to his case without harming others, the Beijing News reported.

A policeman who rushed to the scene was the only other person injured in the explosion, the state-run China Radio International said.

"He warned those passing by ... what a good member of the public, who in this country is willing to stand up and say they are more righteous than him,"' Zhao Xiao, a professor at the Beijing Institute of Technology wrote on the Twitter-like Sina Weibo site.

"By warning others to move away, he is a good person ... I hope authorities will be understanding, or they will set off a vicious cycle," lawyer Yuan Yulai wrote.

"He was not as crazed as the police who beat him in the first place," another Sina Weibo user said.

Mr Ji moved from the eastern province of Shandong to work as a motorcycle driver in the southern city of Dongguan, where he was severely beaten by police staff in 2005, causing him to become disabled, according to multiple reports which could not be independently verified.

He had "lost all hope with society", following an unsuccessful battle for compensation, Hong Kong broadcaster Phoenix TV reported.

Mr Ji was arrested at the scene and taken to hospital where he had his left hand amputated, the broadcaster said.

Lawyers for Mr Ji could not be reached on Sunday. Phoenix TV said at least one lawyer could not comment due to "pressure" from the local government in Dongguan.

Reports said Mr Ji had grown frustrated at China's "petitioning" system, which allows citizens to file complaints directly with government departments.

Petitioners whose complaints have been ignored have for decades staged protests across China, with some using violent acts to draw attention to their case.

An unemployed man who had been a petitioner killed 47 people last month by setting off an explosion on a bus in the coastal city of Xiamen, state media reported.

Internet users favourably contrasted Mr Ji's decision to warn passengers with the behaviour of the petitioner behind the Xiamen attack.

"It's a big step forward ... because Ji chose to inflict the smallest amount of injury,'' one Sina Weibo user wrote.

Canada: Team Canada narrows down scholarship candidates list

Team Canada has narrowed down to just four names its list of drivers still in the running for their scholarship: Olivier Bedard, Thomas McGregor, Zacharie Robichon and Craig Willis.

The eventual two winners will get to race at the prestigious Formula Ford Festival, in Brands Hatch, UK, an annual Ford Ford competition which has brought up many professional drivers, such as Mark Webber and Jenson Button.

"This is a very strong group of drivers as usual out of F1600," believes Brian Graham, founder of Team Canada, a non-profit program funded 100% by donations and sponsorship, which goal is to help foster Canadian talent in motor racing.

"Like the two previous years, we believe any one of them would represent us well this coming October at Brands Hatch. It is always a difficult decision to make, and we look forward to seeing how the season progress's for all of them."

Garett Grist (2012) and Xavier Coupal (2011) are the past winners of the three-year-old Team Canada scholarship program.

Microsoft's Surface tablets: A trip down memory lane, via Apple

Screen Shot 2013-07-20 at 10.06.46 AMFORTUNE -- I don't spend a lot of time writing about Microsoft (MSFT) these days, but the company's re-entry into the tablet market last summer felt like news I should be covering.

After all, Apple (AAPL) had succeeded where Microsoft had, for so many years, failed. And now Redmond was back, gunning for the iPad.

So I watched Microsoft introduce the Surface RT and the Surface Pro last June, curious to see what they might mean for Apple, and I wrote a series of blog posts tracking the progress of the new devices.

Now that we have solid evidence -- in the $900 million write-down Microsoft announced Thursday?to account for unsold Surface RTs -- that the company's latest forays into the tablet market have been less than a stellar success, this may be a good time (and the perhaps the only time) to look back at my Surface stories.

    In chronological order:

    • Video: Microsoft unveils its answer to Apple's iPad. "?It's easy to forget that Bill Gates announced the specs for Microsoft's first tablet computer in 2001, nearly a decade before Apple came out with the iPad."?June 19, 2012
    • Microsoft's new tablet: The unseemly chortling of the Apple partisans. "The Surface is greeted with guffaws and catcalls from a camp that ought to know better."?June 19, 2o12
    • Gartner sees Microsoft stealing market share from Apple. "By 2016, it predicted in April, Windows 8 will be No. 3 in tablets and No. 2 in smartphones."?June 20, 2012
    • Why Microsoft is building its own tablet computers. "There is no longer enough profit, writes John Gruber, in selling software alone."?June 21, 2012
    • Apple lovers kick Microsoft's Surface while it's down: "One minute and 18 seconds of awkwardness draws millions of viewers on YouTube." June 22, 2012
    • Poll: Which comes first, Microsoft's Surface or Apple's television set? "One is vaporware. The other a rumor." June 25, 2012.
    • Macalope v. Winotaur on the Microsoft Surface: "WINOTAUR: You're just upset because now?we're?the most exciting company in tech. MACALOPE:?Uh-huh." June 26, 2012
